Village of Clinton

The meeting opened at 7:00 pm.
Members present were President Mowery, Dianne Davis, Carl Habrick, Laurence Peters, Larry Sines, Joe Orban and Todd Morgan.
Motion was made by Sines and seconded by Peters to approve the July 7, 2009 Council minutes as amended. Motion carried unanimously.
Council walked outside so Fire Chief Dennis Keezer could show and explain the extensive repairs made to engine one.
Motion was made by Orban and seconded by Habrick to award the Tate Park Grant Project bid to Brady Sand and Gravel in the amount $197,045.50. Motion carried unanimously.
The Tate Park Grant project bids came in under budget so the Village is exploring the possibility of using the remaining funds for other grant related projects. The state will have to approve any additional work.
Motion was made by Orban and seconded by Davis to direct the Village Manager to get cost estimates for possible Tate Park Grant improvements to expand the girl’s bathroom for softball, construct ADA path for improved access to softball fields, and install some new play equipment. Motion carried unanimously.
Motion was made by Peters and seconded by Morgan to adopt Ordinance Number 02 of 2009. An ordinance to repeal the Village section 11-51 through 11-71, peddlers, solicitors and transient traders, of the Village codified ordinances, and replace it with new regulations. Motion carried unanimously.
Motion was made by Habrick and seconded Morgan to authorize addition engineering work for the Tecumseh Road construction project with Washtenaw Engineering Company for a cost not to exceed $11,464.00. Motion carried unanimously.
Motion was made by Habrick and seconded by Sines to authorize the Village Manager to send a letter to our congressional representative expressing concerns about the cap and trade legislation. Motion carried unanimously.
Motion was made by Orban and seconded by Sines to go into close session to discuss possible settlement of pending litigation pursuant to section 8(e) of the Open Meetings Act. Motion carried unanimously with a roll call. Close session started at 8:02 pm.
Motion was made by Sines and seconded by Habrick to go into open session. Motion carried unanimously. Open session started at 8:29 pm.
Motion was made by Morgan and seconded by Sines to go into close session to discuss attorney client communication pursuant to section 8 of the Open Meetings Act. Motion carried unanimously with a roll call. Close session started at 8:30 pm.
Motion was made by Morgan and seconded by Peters to go into open session. Motion carried unanimously. Open session started at 8:56 pm.
The Village Manager
explained the requested settlement agreement related to the canvassing
complaint.
Motion was made by Habrick and seconded by Orban to receive and file the council information packet. Motion carried unanimously.
The following comments were from Council. Dianne Davis had questions about the traffic light on Franklin Street. Todd Morgan stated that he thought the utility poll by Jacks Car Wash was leaning.
Motion was made by Habrick and seconded by Orban to adjourn. Motion carried unanimously.
